Persistence pays off.
Following the LPA’s refusal decision, permission has been granted by The Planning Inspectorate for the removal of a condition which restricted the occupancy of a nursing home to the manager and their family.
Evidence was presented that owning to operational reasons and the manner in which the residential care home functions, a permanent on-site member of staff is not required, resulting in the property being vacant for a significant period of time, which would not be desirable.
The Planning Inspectorate agreed that the condition was not reasonable or necessary.
