Planning Permission in National Landscape (AONB)

Our rural expert Andrew Brough MRTPI has started the year on a high, securing planning permission for a Part 6 application in the Chiltern Hills National landscape (AONB), enabling the client to diversify their agricultural operations by erecting a steel frame and metal clad building to support the production of cider. The building will be used to support apple pressing, fermentation and the long-term storage of apples and finished bottles.

The barn had been purposely designed to appear discrete and blend in with the protected landscape, being of a low ridge height and long design to reflect the proportions of the adjacent hedgerow.

Andrew, successfully demonstrated to the council the operational needs for the building to support the farming activities and that this outweighed any potential harm inflicted upon the protected landscape.

Assignment

CT Planning applied to secure permission for the retention of a marquee at the Listed Alrewas Hayes Farmhouse.

Chris Timothy successfully demonstrated that the marquee allows the growth and expansion of a business in a rural area, whilst causing no harm to the Grade 2 listed Alrewas Hayes Farmhouse and as such is supported by the National Planning Policy Framework.

Permission was granted for retention of the marquee for 5 years. This has allowed the client to continue to use the beautiful site as a wedding venue and further develop their successful business.

Outcome

The Challenge

The Hidderley family have been farming at Elford Lowe Farm since 1919. They have always been proactive decision makers, having moved from a successful dairy unit with 400 cows to more than 400 acres of potatoes, and now, 1,000+ acres of combinable crops.

In response to the varying challenges of agriculture, and when the dairy unit closed, the family identified a need to further diversify activity at Elford Lowe Farm through the change of use of its buildings at Elford Lowe Farm to a range of employment uses.

The Solution

CT Planning has prepared planning applications and secured planning permission for the change of use of the buildings at Elford Lowe Farm to employment uses within Use Classes E. The planning applications presented some challenges raised by the access to the site and the fact that Elford Lowe Farm is a listed building, and there is a Scheduled Ancient Monument nearby.

CT Planning was successful in addressing these issues and negotiating the planning permission. The buildings comprise 4,150 square metres and are now fully let; many are occupied by local businesses.

Elford Lowe Farm is just one of the many rural diversification projects for which CT Planning has enhanced the value of land and buildings by securing planning permission for changes of use. Others include residential conversions, wedding venues, tourist accommodation, and renewable energy.

 designed a contemporary clubhouse and grandstand that respected the strong history of the club whilst providing an appropriate response to its setting. With several procedural and technical difficulties to navigate, it is with great pleasure that BRFC and the community can now enjoy the extensive sports facilities at the ground. The Assignment

CT Planning obtained consent following an Appeal to the Secretary of State for a Class Q application for the change of use of an agricultural building to five dwellinghouses in Shropshire. The main issue was whether the extent of the proposed building operations fell within the definition of development permitted Class Q.

The Inspector found the structural integrity of the building is sound and would form an integral part of the new dwellings. A partial award of costs was made against the Planning Authority.
